Authorization

I/We hereby authorize JB Utility Locating LLC to perform a private utility locate on the above-referenced property. Work includes electromagnetic and/or other methods, as needed, to mark customer-owned private utilities beyond the public meter and main connections.

Objects are marked with permanent spray paint unless otherwise instructed. Private locating can identify the paths of known utilities, but it is not a method for clearing areas of utilities, nor does it limit or eliminate liability during excavation. JB Utility Locating LLC charges a fee based on travel time to the work site and the duration of locating. A minimum of two hours will be charged. The owner must be present at the locate.

MN Specific Requirements & Acknowledgements

(Per MN Statutes Ch 216D & Rules 7560)

• Client confirms an active Gopher State One Call (GSOC) ticket is in place with white markings defining the excavation area. 
• Private utilities will be marked with standard APWA public colors. Markings are approximate horizontal locations only (±24-inch tolerance zone on either side of markings per state rules). 
• Client must hand-dig (or use vacuum excavation) within 24 inches of all markings. Depth is NOT guaranteed. 
• Locate is valid only for [e.g., 14 days or as noted on GSOC ticket] from the date of marking. Any changes require a new request. 
• Non-conductive, abandoned, or shielded lines may not be locatable.

Scope & Limitations (EM) Locating

• The client agrees that they have used or will have used 811 (Call Before You Dig) to identify publicly owned utilities before any excavation begins.
• Client acknowledges and agrees that any markings and locations provided by JB Utility Locating LLC are to be used as a supplementary tool only to assist the client. The surveys and/or reports provided by JB Utility Locating LLC are not intended to be used as a primary guide.
• Client agrees to take the same care in any construction or excavation work as it would have done if the services of JB Utility Locating, LLC had not been provided. By signing below, the client agrees that they have read and acknowledged the following description of electromagnetic (EM) locating:
  • EM can be used on nearly all metal pipes, wires, cables, or plastic pipes with tracer wire. Objects that do not conduct electricity cannot be detected with conventional EM. This includes pipes made from plastics, concrete, or terra-cotta. Items that block signal propagation (like rubber gaskets) or reception (such as sheathing) can significantly reduce locating accuracy.
  • During EM, a signal can bleed onto nearby pipes or be affected by nearby masses of metal; this can influence the accuracy of locating equipment. The locations provided by JB Utility Locating LLC are based on the received signal, which may differ from the actual location of the object emitting it. Limitations can occur mainly due to: utility access points that are not visible from above ground, utilities not identified by the client, utilities not present in the as-built documentation, or objects to be located that cannot carry an EM signal (primarily because of material of construction, sheathing, or disconnections such as couplers, breaks, or repairs in the line).
• Only utility lines directly communicated to JB Utility Locating, LLC from the client are subject to being marked.

Indemnification & Liability

• The client is solely responsible for properly executing any excavation work and shall employ qualified operators with appropriate liability insurance and/or bonding.
• The client agrees to indemnify, defend, and hold harmless JB Utility Locating LLC, its employees, and agents from and against all liabilities, damages, losses, claims, suits, judgments, and expenses (including reasonable legal fees) arising from:
  • JB Utility Locating LLC’s failure to locate underground services due to the limitations described above; 
  • The client’s failure to follow the plans, markings, or instructions provided by JB Utility Locating LLC; 
  • The proper performance of JB Utility Locating LLC’s services under this Agreement;
  • Any action or inaction of the client, whether in reliance on the services provided by JB Utility Locating LLC; 
  • Any claims, damages, or liabilities related to the locate or subsequent excavation.
• UNDER NO CIRCUMSTANCES shall JB Utility Locating LLC be liable for special, incidental, consequential, indirect, punitive, or exemplary damages, loss of goodwill, business profits, or any other commercial damage, even if advised of the possibility of such damage.
• JB Utility Locating LLC makes no warranty of merchantability, fitness for a particular purpose, or any other express, implied, or statutory warranties. All provisions regarding limitation of liability, disclaimers, and exclusion of damages are severable and independent.
• Private facilities remain the owner’s responsibility per MN Statute 216D.04. JB Utility Locating LLC is not liable for unmarked or inaccurately located lines.

Payment & Terms

A $250 deposit (50% for jobs >$500) is due with the Authorization Agreement to secure the locating appointment. The remaining balance is due at the time of service. Cancellation within 24 hours: 50% fee.
